Your agreement with us
These Terms and Conditions (“Terms”) form a contract between you and OSIS SARL, operating the Faarli Rentals application and marketplace under the Faarli brand from Casablanca, Morocco (“Faarli”, “we”, “us”). They apply when you access the app, create an account, request a booking, use rewards, or otherwise use our services.
By creating an account or confirming a booking, you acknowledge these Terms and the applicable booking summary. If you do not agree, do not use the Service. Mandatory consumer rights always prevail over a conflicting clause in these Terms.
Definitions
- “App” or “Service” means Faarli Rentals, including marketplace search, accounts, verification, booking, payments, notifications, support, pickup evidence, reviews, and rewards.
- “Agency” means the professional vehicle-rental business identified in a listing and booking.
- “Rental Contract” means the vehicle-rental agreement between you and the Agency, including the booking summary and the Agency’s disclosed vehicle, insurance, deposit, mileage, fuel, cancellation, driver, and return conditions.
- “Booking Request” means your request for an Agency to rent the selected vehicle for the stated dates and price.
- “User Content” means information, photos, documents, videos, reviews, and other material you submit.
Faarli’s role and the Agency’s role
Faarli provides the technology that lets you discover vehicles, verify your profile, submit a Booking Request, pay, communicate, document pickup, and receive a contract. Unless a listing expressly identifies OSIS SARL as the rental provider, the Agency—not Faarli—is the vehicle owner or rental supplier and is responsible for the vehicle, rental eligibility, handover, insurance, maintenance, roadside arrangements, and performance of the Rental Contract.
Faarli may act as the Agency’s disclosed technical or payment intermediary. We do not become a party to the Rental Contract merely by transmitting information or collecting payment. We remain responsible for our own platform obligations and cannot exclude a responsibility imposed on us by law.
Eligibility to use and rent
You must:
- be at least 18 and legally capable of contracting;
- hold a valid driving licence accepted in the country of rental and meet the Agency’s minimum age and licence-history rules;
- have authority to use the selected payment method and provide the guarantee where required; and
- comply with traffic, immigration, sanctions, insurance, and other applicable laws.
An Agency may lawfully impose additional eligibility requirements disclosed before confirmation or in the Rental Contract.
Account registration and security
Provide accurate, current, and complete information and keep it updated. You may register with email and password or an available Google or Apple sign-in. One person may not create misleading, duplicate, transferred, or impersonating accounts.
Keep credentials and one-time codes confidential, protect your device, and notify support@faarli.compromptly of suspected misuse. You are responsible for activity you authorise, but not for unauthorised activity caused by our breach of duty or another matter for which the law makes us responsible.
Identity, licence, selfie, and phone checks
Before booking, you must complete the rental profile and submit a current identity document, driving-licence images, and a selfie. Phone verification through a one-time WhatsApp code may also be required. You authorise Faarli and the relevant Agency to review this material for eligibility, safety, fraud prevention, insurance, and Rental Contract administration as described in our Privacy Policy.
Approval means only that the submitted information passed the checks then applied. The Agency may inspect original documents at pickup and may refuse handover where documents are invalid, altered, expired, do not match the driver, or do not meet disclosed requirements.
Listings, availability, and vehicle substitutions
Agencies provide vehicle descriptions, images, location options, availability, mileage, extras, eligibility rules, and other listing details. Faarli takes reasonable steps to display this information accurately, but availability and details may change before the Agency accepts a Booking Request.
If the selected vehicle becomes unavailable, the Agency may propose a reasonably comparable substitute. You may accept it, or decline and receive any refund required by the booking terms and applicable law. A material substitute or price change requires your agreement.
Booking and electronic contracting
- You select the vehicle, dates, locations, delivery, extras, currency, and any points to redeem.
- The App shows a summary of the price and guarantee before you confirm and pay.
- Payment creates a pending Booking Request; it does not by itself guarantee Agency acceptance or vehicle handover.
- The booking becomes accepted when the Agency approves it and the disclosed guarantee authorisation, if any, succeeds.
- The Rental Contract and pickup process complete the terms governing actual possession and use of the vehicle.
You consent to electronic records and communications. Our records of confirmations, versioned terms, payments, and booking events may be used as evidence, subject to applicable law and your right to prove otherwise.
Prices, currencies, extras, and taxes
The order summary shows the rental price, selected extras, displayed currency, and guarantee amount known at checkout. Agency base prices are set in Moroccan dirhams (MAD); another displayed currency may be calculated using the current in-app exchange rate. Your bank or card provider may apply its own conversion rate or fees.
Costs arising after pickup—such as additional kilometres, fuel, cleaning beyond normal use, tolls, traffic penalties, late return, loss, or damage—are governed by the Rental Contract and must be supported and charged lawfully. Applicable taxes are included or identified as required by law.
Payment processing
Card payments are processed by Stripe. By confirming payment, you authorise the disclosed rental charge and Stripe’s processing under its terms. Faarli does not store your full card number or security code. A payment may be rejected, delayed, or require authentication by your bank.
If a paid Booking Request is rejected or cannot be supplied and no substitute is accepted, Faarli and/or the Agency will arrange the refund due to the original payment method. Bank and card-network processing times are outside our control, but this does not reduce any statutory repayment deadline.
Refundable guarantee authorisation
The amount shown as a “guarantee” is normally a temporary card authorisation placed after the Agency accepts the paid booking. It reduces your available balance but is not a charge unless some or all of it is captured under the Rental Contract—for example for documented damage, loss, penalties, excess mileage, fuel, or late return.
The Agency must provide the contractual basis and reasonable evidence for capture. Unused amounts must be released. Your bank determines when the released balance becomes visible. Contact the Agency first to contest a capture, and copy Faarli support so we can assist with platform and payment records.
Cancellation, withdrawal, no-show, and refunds
The cancellation and no-show terms shown for your booking or supplied by the Agency form part of the Rental Contract. To cancel where no self-service control is available, contact the Agency and support@faarli.com without delay. The applicable refund depends on timing, work already performed, Agency terms, and mandatory law.
Nothing in these Terms waives a statutory right of withdrawal or refund. Whether such a right applies may depend on the nature of the dated rental service and whether performance began at your express request. If the Agency cancels without a lawful user default, you are entitled to a substitute you accept or the refund required by law.
Pickup, inspection video, use, and return
Arrive on time with the original documents, accepted payment method, and any additional item stated in the booking. Before taking the vehicle, inspect it and record the required walk-around video in the App. The video protects both parties by documenting visible condition at pickup; record the vehicle and avoid bystanders or private speech.
During the rental you must use the vehicle lawfully, follow the Rental Contract, permit only approved drivers, secure keys and documents, report accidents or breakdowns promptly, and not sell, sublet, pledge, race, overload, or use the vehicle for an unlawful purpose. Return it at the agreed place and time, subject to any written change accepted by the Agency.
User Content and reviews
You keep ownership of User Content. You grant Faarli a limited, worldwide, non-exclusive licence to host, secure, reproduce, process, and disclose it only as needed to provide, protect, evidence, and improve the Service and fulfil legal duties. Identity and pickup evidence are handled under the Privacy Policy, not published as social content.
Reviews must reflect a genuine completed rental and may not be unlawful, discriminatory, threatening, deceptive, infringing, or reveal another person’s private data. We may moderate content for these reasons while preserving fair consumer feedback.
Faarli points and referrals
Points are promotional, personal, non-transferable, have no cash value, and may be used only under the rules shown in the App. Rules may include qualifying rentals, minimum duration, redemption limits, expiry, and exclusions. Referral rewards are granted only after the stated genuine-user milestones are met.
We may correct duplicate or erroneous credits, reverse points linked to a refund, chargeback, fraud, or cancelled qualifying event, and suspend abuse. We will give reasonable notice of material prospective changes and will not remove valid accrued points arbitrarily before their disclosed expiry.
Acceptable use
You must not:
- submit false, altered, stolen, or another person’s documents;
- evade eligibility, payment, guarantee, security, geographic, or account restrictions;
- scrape, reverse engineer, overload, disrupt, probe, or introduce malware into the Service except where law expressly permits;
- use automated means to manipulate listings, rewards, referrals, reviews, or availability; or
- infringe rights, harass others, or use the Service or a vehicle for fraud or any unlawful activity.
Faarli intellectual property
Faarli, the App, software, interface, text, trademarks, graphics, and service content are owned by OSIS SARL or its licensors and protected by applicable law. We grant you a limited, revocable, non-transferable, non-exclusive licence to install and use the App for personal rental purposes in accordance with these Terms. No ownership right is transferred to you.
Third-party services
The Service interoperates with Stripe, Apple, Google, Firebase, maps, WhatsApp communications, and other providers. Their terms and privacy notices apply to services they independently control. Faarli is not responsible for a third party’s independent service, but remains responsible for selecting and using processors as required by applicable law.
Suspension, termination, and account deletion
You may stop using the Service and delete your account in the App. Active bookings, payment obligations, claims, and provisions intended to survive remain governed by these Terms and the Rental Contract.
We may restrict or suspend an account where reasonably necessary for security, fraud prevention, legal compliance, non-payment, risk to persons or vehicles, or a material breach. Except in an urgent or legally prohibited case, we will give notice and a reasonable opportunity to respond. Account deletion and record retention are described in the Privacy Policy.
Service availability and responsibility
We use reasonable skill and care to operate and secure the Service, but temporary maintenance, network, bank, mapping, or provider issues may affect it. We do not promise uninterrupted availability or that every Booking Request will be accepted.
Each party is responsible for loss it causes under applicable law. The Agency is responsible for the vehicle and its performance of the Rental Contract. Faarli is responsible for its own platform and payment-intermediation duties. To the extent permitted by law, neither party is responsible for remote or unforeseeable indirect loss. No clause excludes liability that cannot lawfully be excluded, including for fraud, wilful misconduct, gross fault, death or personal injury caused by fault, or mandatory consumer protection.
Events beyond reasonable control
A party is not liable for delay caused by an unforeseeable and unavoidable event beyond its reasonable control, to the extent the event prevents performance and the affected party takes reasonable steps to reduce the impact. Payment and refund obligations already due, and mandatory consumer remedies, remain unaffected except where law provides otherwise.
Changes to the Service or these Terms
We may update the Service and these Terms for legal, security, technical, or product reasons. The version accepted for an existing booking continues to govern that booking unless a change is required by law or you expressly accept it. We will provide reasonable notice of material changes affecting future use. Continued use after the stated effective date means acceptance where legally valid.
Governing law, complaints, and disputes
Moroccan law governs these Terms. Start a complaint with the Agency for vehicle or Rental Contract issues and copy support@faarli.com; contact Faarli directly for account, platform, payment-record, privacy, or rewards issues. Include the booking reference and supporting evidence so the complaint can be investigated.
The parties will first try to resolve the matter amicably. If that is not possible, Moroccan courts have jurisdiction subject to any mandatory consumer right to bring a claim before another competent court. These Terms do not prevent you from contacting a competent consumer, data-protection, payment, or judicial authority.
General provisions and contact
If a clause is invalid, it will be limited or removed only to the extent necessary and the remaining clauses continue. A delay in enforcing a right is not a waiver. You may not transfer your account or these Terms without our consent; we may transfer them with the business where your rights are not reduced and applicable notice is given. Headings aid reading and do not alter meaning.
